Terms
The agreement between you and us for using Candid Beacon.
Effective [TO SUPPLY: OWNER_EFFECTIVE_DATE].
Not yet reviewed. This document has the right structure and the right facts about the service, but the terms themselves have not been drafted or checked by a lawyer, and the parties are not yet named. It should not be relied on as it stands.
1. Who you are agreeing with
These terms are between you and [TO SUPPLY: OWNER_LEGAL_NAME], trading as [TO SUPPLY: OWNER_TRADING_NAME] ([TO SUPPLY: OWNER_ENTITY_STATUS]), of [TO SUPPLY: OWNER_POSTAL_ADDRESS]. "We" and "us" mean that party.
2. What the service is
Candid Beacon lets you publish a page showing how booked you are, when you are next available, and information you choose to add. That page can be read by anyone who has its link, without an account. You can also publish the same status as an embeddable badge, and collect email addresses from people who want to hear from you when you have capacity.
The figure on your Beacon is the one you last published. The service does not read your calendar and does not update your public page on its own.
3. Accepting these terms
Creating an account or using the service means you accept these terms. If you do not, do not use it.
4. Your account
You are responsible for what happens under your account and for keeping access to it secure. Sign-in is handled by our sign-in provider; deleting your account is done through that provider's own control, and what happens to your data afterwards is described on the privacy page.
5. What you publish
Your bio, testimonials, banner text and waitlist wording are yours, you are responsible for them, and they are public the moment you publish them. Testimonials you enter are quotes you are asserting somebody gave you.
[TO SUPPLY: OWNER_LEGAL_NAME] may remove content or suspend an account for breach of acceptable use. The acceptable-use terms have not been written.
6. People on your waitlist
When somebody joins your waitlist, you are the one deciding to hold and use their address; we operate the mechanism on your behalf. That carries obligations you cannot delegate to us - in particular, only mailing people who asked to hear from you, and honouring a request to stop.
Every message we send on your behalf carries a one-click unsubscribe link, and that link cannot be turned off.
7. Price and payment
The service is currently free. No paid tier exists yet, so there is nothing to pay and no payment terms to agree. When there is, these terms will change before it goes on sale, not after. See refunds.
8. Availability
No uptime figure is promised, because none has been measured and a number here would be invented. [TO SUPPLY: OWNER_LEGAL_NAME] may change or withdraw features.
9. Liability
[TO SUPPLY: OWNER_LEGAL_NAME] — liability terms not drafted. This clause needs to be written, and its limits depend on the jurisdiction in clause 11.
10. Ending it
You can stop using the service and delete your account at any time. What is erased, how quickly, and the one record that survives, are all on the privacy page.
11. Governing law
[TO SUPPLY: OWNER_JURISDICTION].
12. Contact
[TO SUPPLY: OWNER_SUPPORT_EMAIL].
